New military justice code adopted in Guinea

The National Assembly of Guinea has adopted a new military justice code, as reported here. The measure seeks to bring the country's system into compliance with international and regional human rights requirements, including those set forth in the International Covenant on Civil and Political Rights. Among other things, it provides for the prosecution of senior and general officers and addresses subject matter jurisdiction over common law offenses. The death penalty is addressed, along with the relationship between the military justice directorate and military courts.
« L’adoption du code de justice militaire présenté, permettra à notre pays de se doter d’un instrument juridique en adéquation avec les exigences des normes du droit international qui garantit à tous les justifiables militaires le droit à un procès équitable tout en luttant contre l’impunité au sein des forces armées. Par ailleurs, l’adoption de ce code de justice militaire révisé pourra consolider le processus de réforme des forces de défense et de sécurité », a expliqué le député uninominal de Gaoual.
